DIMR App Terms of Service

Welcome to DIMR, an educational app designed to help families build their family tree and learn about their heritage. By accessing or using the DIMR app (“App”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the DIMR App, you agree to these Terms and our Privacy Policy. If you disagree, please do not use the App.

2. Description of Service

DIMR offers a family tree-building service with various subscription plans:

• Brass Plan (Free): Add up to 10 family members with ten photos and access to free fun activity pages.
• Silver Plan ($4.97/month): Add up to 15 family members with photos, 65 album photos, access to free fun activity pages, and two free eBooks with an annual plan.
• Gold Plan ($9.97/month): Unlimited family members and photos, unlimited photo albums, access to free fun activity pages, and five free eBooks with an annual plan.

The App has two versions: an adult version with promotions in the news section and a children’s version with no advertising, a family tree photo album, and a bookstore with audio and downloadable books. Audiobooks are available via subscription, and downloadable books are sold individually.

3. Eligibility

To use the DIMR App, you must be at least 18 or have parental consent if you are a minor. The children’s app version requires parental consent for users under 13.

4. User Accounts

You must create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information and all activities under your account.

5. Subscription Plans

Subscription fees are billed monthly or annually, depending on the chosen plan. You can manage your subscription and cancel it anytime through your account settings. Subscription fees are non-refundable except as required by law.

6. User Content

You can upload and share content using this App, including photos and information about your family members. You retain ownership of the content you upload but grant APPe Nik inc./DIMR a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content within the App to family members you wish to share with.

7. Privacy and Data Protection

We take your privacy seriously and are committed to protecting your personal information. Please review our Privacy Policy to understand how we collect, use, and protect your data.

8. Prohibited Activities

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Interfere with or disrupt the App’s operation.
• Upload or transmit any harmful, offensive, or infringing content.

9. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that violates these Terms or harms other users.

10. Limitation of Liability

DIMR and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from or in connection with your use of the App.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after such changes indicates your acceptance of the new Terms.
